Terms of Service

These Terms of Service (“Terms”) form an agreement between you and Modern Freight Broker Academy (“MFBA,” “we,” “us,” or “our”). By purchasing, accessing, or using MFBA, you agree to these Terms and the linked Privacy and Refund Policies.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter a contract. You must provide accurate information, protect your credentials, and notify us of unauthorized access. One purchase grants access to one individual unless a written team license says otherwise.
2. Educational service
MFBA provides self-paced freight brokerage education, learning tools, resources, assessments, and a private certificate of completion. Content may be updated, reorganized, replaced, or retired to maintain the program.
3. No professional advice
Course materials are general educational information and not legal, tax, accounting, insurance, financial, safety, or regulatory advice. Laws, regulations, rates, market conditions, and vendor requirements change. Consult qualified professionals and primary government sources for decisions affecting your business.
4. No results guarantee
We do not guarantee employment, certification by a third party, customers, revenue, profit, funding, authority approval, or any specific outcome. Testimonials and examples are illustrative and do not promise typical or future results.
5. Purchases and payment plans
Prices are shown in U.S. dollars unless stated otherwise. Stripe processes checkout. You authorize the applicable payment or installment schedule and are responsible for taxes and fees. A payment plan is a commitment to the full stated purchase price, not a cancellable month-to-month subscription. Failed or disputed payments may result in suspended access, subject to applicable law.
6. Refunds
Refund requests are governed exclusively by the Refund Policy in effect at purchase. Nothing in these Terms limits non-waivable consumer rights.
7. License and acceptable use
MFBA grants you a limited, personal, non-exclusive, non-transferable, revocable license to use course content for your own education. You may not:
- Share credentials or provide course access to another person
- Copy, record, scrape, republish, sell, sublicense, or distribute course content
- Remove copyright, trademark, or attribution notices
- Use automated systems to extract content or interfere with the service
- Attempt unauthorized access, bypass access controls, or introduce malicious code
- Use the service unlawfully or to infringe another person's rights
8. Intellectual property
MFBA content, branding, curriculum structure, text, graphics, software, and resources are owned by MFBA or its licensors and protected by intellectual property law. “Modern Freight Broker Academy,” “MFBA,” and the official logo may not be used without written permission.
9. Student submissions and conduct
You retain ownership of original information you submit. You grant us permission to process it to operate and support the service. You may not submit unlawful, infringing, deceptive, abusive, or harmful content.
10. Third-party services
Links and references to Stripe, government agencies, software, load boards, and other third parties are provided for convenience or instruction. We do not control or endorse their availability, pricing, terms, accuracy, or performance unless expressly stated.
11. Availability and termination
We may perform maintenance, address security incidents, and modify service features. We may suspend or terminate access for material breach, fraud, abuse, unlawful conduct, credential sharing, or infringement. Provisions that by their nature should survive termination will survive.
12. Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.
13. Limitation of liability
To the maximum extent permitted by law, MFBA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, data, opportunities, or goodwill; or business interruption. Our aggregate liability relating to the service will not exceed the amount you paid MFBA for the product giving rise to the claim during the 12 months before the event. Some jurisdictions do not allow certain limitations, so they may not apply to you.
14. Indemnity
To the extent permitted by law, you agree to defend and indemnify MFBA from third-party claims arising from your unlawful use, violation of these Terms, infringement, or operation of a freight business.
15. Governing law and disputes
These Terms are governed by the laws applicable in the U.S. state where MFBA is principally established, without regard to conflict-of-law rules. Before filing a claim, each party will make a good-faith effort for 30 days to resolve it informally by written notice. Mandatory consumer rights and jurisdiction rules remain unaffected.
16. General terms
If any provision is unenforceable, the remainder remains effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms and incorporated policies are the entire agreement about the service.
17. Changes and contact
We may update these Terms prospectively. Material changes will be indicated by the updated date or another reasonable notice. Questions may be sent to [email protected].
